Contest Rules

 

  1. The “Win a heliski trip to Blue River” contest is held by Bel Cheese Canada Inc. (the “Contest Organizer”). The contest will run on the Internet from 12:00 a.m. ET on January 12, 2009, to 11:59 p.m. ET on April 10, 2009 (the “Contest Period”).

ELIGIBILITY

  1. This contest is open to persons residing in Canada who have reached the age of majority in their province or territory of residence. Are not eligible, the employees, agents and representatives of the Contest Organizer, any company, trust or other legal entity controlled or related to it, its advertising and promotional agencies and its suppliers of prizes, products, services and material related to this contest, as well as members of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse and any individuals with whom such employees, agents and representatives are domiciled.

HOW TO ENTER

On the Internet

  1. No purchase required. To enter, visit www.minibabybel.ca website during the Contest Period. Follow the instructions to access the electronic entry form (the “Entry Form"). Complete the Entry Form by entering your first name, last name, email address, complete address (including the postal code), telephone number (including the area code), age and the correct answer to the mathematical skill-testing question. You must then complete the survey and confirm that you have reached the age of majority in your province or territory of residence, that you are eligible to enter the contest and that you have read and accepted the contest rules. You must then click on “Register” to send your Entry Form no later than April 10, 2009 at 11:59 p.m. ET. Upon receipt of a confirmation message, you will then automatically be entered in the contest.
  2. Entrants must respect the following limits, otherwise they may be disqualified. There is a limit of one (1) entry per email address per week. At any time during the Contest Period, entrants may only use one (1) email address even if they have more than one.

PRIZE

  1. One (1) prize is offered. The prize consists of a 3-day and 4-night heliski trip for four (4) people in Blue River, British Colombia, of an approximate value of $25,000, including:
    1. roundtrip airfare in Economy class between the International airport nearest to the winner’s residence and Vancouver or Kelowna;
    2. transfers at destination between the airport and the hotel;
    3. 4-night deluxe accommodation, based on double occupancy, in Blue River, at the Contest Organizer’s choice;
    4. 3 days of heliski for each person at Blue River with a professional guide;
    5. 3 gourmet meals/day (lunch is served in the mountains);
    6. ski or snow board rentals (standard equipment).
  2. The following restrictions apply to the prize:
    1. to participate in the heliski, the guests that are minors must be accompanied by a parent or legal guardian;
    2. in the event that the winner and his/her guests live at a distance from Blue River that does not require air transportation, the Contest Organizer will provide, at its sole discretion, an alternate mode of transportation;
    3. all fees and expenses other than those specifically mentioned above shall be assumed by the winner and his/her guests, namely, roundtrip transportation fees from the place of residence to the departure airport, bus or train station, personal insurance, non-included taxes and gratuities, non-included meals and beverages, internet access charge, mini-bar charges, room service, local and long distance telephone calls, personal expenses or travel documents fees, if required;
    4. subject to what is set forth in the contest rules and subject to availability, the trip must be taken during the 2009-2010 ski season, except for the following periods : from January 25, 2010 to March 15, 2010, otherwise it will be null and void;
    5. reservations related to the trip are required to be made by the winner with the Contest Organizer within the prescribed deadline set by the Contest Organizer. The winner must provide the Contest Organizer with the name appearing on his/her passport or on his/her identification document used to travel, as well as the name and personal coordinates of the persons accompanying him/her. Once the arrangements are completed, no modifications will be accepted;
    6. the winner and the persons accompanying him/her, must travel together;
    7. the winner and his/her guests must have the experience and fitness required to participate in the heliski and they shall sign, if required, any release form in favour of Mike Wiegele Helicopter Skiing or any supplier of products and services related to the activity. If the winner and/or one of his/her guests does not have the experience or the fitness required to participate in the heliski, he/she will have the opportunity to ski on a “traditional” slope, at the Contest Organizer’s discretion;
    8. if any part of the trip is not used, no compensation will be awarded to the winner or to the persons who accompany him/her;
    9. the approximate value of the prize is based in part on the average value of the air transportation portion of the prize, which may vary depending on the date and point of departure. No compensation will be paid nor can any be claimed to this effect if the prize value is inferior, notably because of winner and guests’ departure point.

DRAW

  1. A random draw of one eligible entry out of all entries duly recorded during the Contest Period will be held on April 16, 2009, at 12 p.m. ET at OSL Marketing’s offices located in Montreal to award the prize described in these contest rules.
  2. Odds of winning. The odds of an entrant’s Entry Form being selected for the prize depend on the number of eligible Entry Forms registered during the Contest Period.

AWARDING OF THE PRIZE

  1. To be declared a winner, the selected entrant must:
    1. Have correctly answered the mathematical skill-testing question appearing on the Entry Form ;
    2. Be reached by telephone by the Contest Organizer within fifteen (15) days of the draw ;
    3. Complete and sign the declaration and release form (the “Declaration Form”) that the Contest Organizer will provide him/her by fax, e-mail or mail and return it to the Contest Organizer within fifteen (15) days of its receipt ;
    4. On request, provide an identification document with photograph.
  2. Failure to comply with any one of the conditions in these contest rules or to accept the prize will cause the winner to be automatically disqualified. In such a case, the Contest Organizer may, at its sole discretion, cancel the prize or hold a new random draw until an entrant is selected and declared a winner.
  3. Within fifteen (15) days after receipt of the duly completed and signed Declaration Form, the Contest Organizer will send by mail to the winner a letter explaining how he/she can take possession of his/her prize.

GENERAL CONDITIONS

  1. The Entry Forms and Declaration Form are subject to verification by the Contest Organizer. Any Entry Form or Declaration Form which is, as the case may be, incomplete, illegible, mutilated, fraudulent, recorded or submitted late, not bearing a valid email address, not bearing the correct answer to the mathematical skill-testing question or otherwise noncompliant may be rejected and will not entitle the entrant to be entered in the contest or to win the prize.
  2. The Contest Organizer reserves the right to disqualify an entrant or to cancel one or several entries by an entrant if he/she enters or tries to enter this contest by using methods that do not comply with these contest rules or that are unfair to the other entrants (ex : entries exceeding the authorized limit). Such an entrant may be reported to the appropriate legal authorities.
  3. The prize must be accepted as described in these contest rules and may not, in any case, in whole or in part, be transferred to another person, replaced by another prize or exchanged for cash, except as provided in the section below.
  4. In the event that the Contest Organizer cannot award the prize (or a portion thereof) as described in these contest rules, it reserves the right to replace the prize (or portion thereof) with one of the same kind and of equivalent value or, at its sole discretion, with the cash value of the prize (or portion thereof) as indicated in the contest rules.
  5. By entering this contest, the person selected releases and holds harmless the Contest Organizer, any company, trust or other legal entity controlled or related to it, its advertising and promotional agencies, and their employees, agents and representatives from and against any damage resulting from the acceptance or use of the prize.
  6. The person selected for the prize acknowledges that from the moment the reservations are made, the fulfillment of prize-related services and products obligations become the full and sole responsibility of the various service suppliers of services and products comprising the prize.
  7. The Contest Organizer, any company, trust or other legal entity controlled or related to it, its advertising and promotional agencies, and their employees, agents and representatives, disclaim all liability for any of the following that may limit or prevent any entrant’s participation in the contest: malfunctioning of any computer component, software or communications line; loss or lack of a communications network; or any transmission that is faulty, incomplete, incomprehensible or erased by any computer or network. The persons mentioned above also disclaim all liability for any damages or loss that may be caused, directly or indirectly, in whole or in part, by the downloading of any Web page or software or by the transmission of any information related to participation in the contest.
  8. The Contest Organizer does not warrant that access to or use of the contest website will be accessible or uninterrupted during the Contest Period or that it will be error-free.
  9. The Contest Organizer reserves the right, at its sole discretion, to cancel, modify or suspend this contest in whole or in part, or to terminate it, should human intervention or an event take place that could modify or affect the administration, security, impartiality or conducting of the contest as provided in these contest rules, subject to approval by the Régie des alcools, des courses et de jeux du Québec, if necessary.
  10. In the event that the computer system cannot record all the contest entries during the Contest Period for whatever reason, or if participation in the contest must be terminated in whole or in part before the ending date of the contest as provided in the contest rules, the Contest Organizer may proceed with the draw among the Entry Forms duly registered during the Contest Period or, as the case may be, up to the date of the event terminating participation in the contest.
  11. The Contest Organizer, shall not be required to award more than one prize or to award a prize otherwise than in accordance with these contest rules.
  12. By entering or attempting to enter this contest, all persons release and hold harmless the Contest Organizer, any company, trust or other legal entity controlled or related to it, their advertising and promotional agencies, and their employees, agents and representatives from and against any liability for damage that said persons may incur as a result of their participation or their attempt to participate in the contest.
  13. By entering this contest, the contest winner authorizes the Contest Organizer and its representatives to use, if required, its name, photo, likeness, statement regarding the prize, place of residence and/or voice for publicity purposes, without any form of compensation.
  14. For the purposes of these contest rules, the entrant is the person whose personal information appears on the Entry Form and it is to this person to whom the prize will be awarded if he/she is selected and declared a winner.
  15. The guests of the winner shall sign the Declaration Form.
  16. In the event that one of the guests of the winner is a minor, the parent or legal guardian of this minor guest, shall accompany him/her and shall also sign the Declaration Form.
  17. Any decision by the Contest Organizer or its representatives regarding this contest is final and without appeal, subject to a ruling by the Régie des alcools, des courses et des jeux du Québec on any issue under its jurisdiction.
  18. For Quebec residents, any litigation respecting the conduct or organisation of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie for the purpose of helping the parties reach a settlement.
  19. No communication or correspondence related to this contest shall be exchanged with entrants except as provided for in the present contest rules or at the Contest Organizer’s initiative.
  20. Entrants’ personal information collected for the purposes of the contest will be used only to administer this contest and no communications unrelated to the contest will be sent to entrants, unless they have otherwise agreed to receive such communications.
  21. If a section of these contest rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law.
  22. In case of any discrepancy between the French and English versions of these rules, the French version shall prevail.
